According to a recent FOX Business News press release, Alpine TLI Group, a public company, announced that:

"There will be over 2,000 tax lien sales during 2008, with an ever-increasing opportunity to participate in online sales. It is estimated that over $10 Billion in tax lien certificates are offered for sale annually. It is also estimated that due to the inherentleverage of a tax lien, this could represent over $1 Trillion in property value for the purchasers of these tax lien certificates."

Southwick, MA files $103,963 worth of tax liens


SOUTHWICK, MA - Town Collector Michelle L. Hill plans to file tax liens against 52 properties if owners fail to pay back property taxes and fees by Jan. 2.

"The liens will be filed at 10 a.m. on Jan. 3 against any property that remains the subject of back taxes," she said yesterday.

The total outstanding tax owned on the 52 parcels is $103,963, Hill said, explaining that additional fines and fees are assessed against each parcel. She was unable to provide a total of fines and fees to be collected, noting that the amount varies for each parcel.

Investors and gamblers one of the main reasons for foreclosures in Bay Area



One fifth of San Francisco's foreclosures are owned by investors

Israel Medina admits he got too gung ho about the idea of getting rich by flipping Bay Area real estate.

Medina, a Concord resident who ran a limousine company before wading neck-deep into the housing market, has seen not one, but 11, of his Northern California properties move into foreclosure in the past year, he said.

"I was a real estate tycoon; I had everything," said Medina. "Now I have nothing."

A Chronicle analysis of public records shows that speculators like Medina played a significant role in the region's subprime loan meltdown.

These real estate gamblers are hardly the struggling home buyers often portrayed as victims of the Bay Area's and nation's foreclosure crisis. Some bought houses as often as other people buy shoes, rarely putting down any money. The speculators were betting that home prices would continue to shoot up. Instead, when the market started softening and prices sagged, many of their properties ended up as foreclosures.

Congress - Take care of our seniors!



Imagine if your grandma fell due to a stroke. In order to walk and talk again she needs outpatient rehab, but after Jan 1, 2008, Medicare will only pay $1810. After that amount is gone, even if she can't walk or talk yet, she is on her own.

We need to tell Congress that Medicare needs to take care of our parents and grandparents. They paid for Medicare all their work life only to be taken when they need it most.

We need to fight this injustice.

Call your congressman and senator and ask them to support The Medicare Access to Rehabilitation Services Act. Please no more blind therapy caps.

    DEAR BOB: We are buying an out-of-state house. The closing is scheduled for about two weeks from now. It is a "for sale by owner," and the sellers aren't too knowledgeable about the sales process. We just received a document from the title company listing the recorded liens against the sellers. The list includes a lien from the state's Bureau of Child Support for more than $12,000 and deferred property taxes for about $2,000. None of these liens were previously disclosed to us. If the sellers are unable to pay these liens at or before the closing, what are our options? We don't want to be homeless when we arrive in our new city if something goes wrong with the closing. --Rebecca L.


    Tax liens are public record and the title company easily saw the problem before closing. Before the deal can move any further, the tax liens must be paid off. This is typical around America, properties that may have old liens against it. In a traditional closing, those liens will need to be removed -- which is fortunate for you, the tax lien investor.

    Tax liens are one of the safest investment vehicles out there, especially on homestead properties. The last part of the letter explains it all, "We don't want to be homeless..."

    More free foreclosure listings

    Bank of America, which also does mortgages, has a foreclosure site as well. Though not as big as Countrywide's foreclosure site, it is still a good place to look at:

    Make sure you do your proper due diligence on these relatively cheap houses. You'll need to do similar title searches like you would with a tax deed sale. The people that waited for the real estate bubble to pop are the smart ones, you can now get a decent house in areas that they weren't able to afford before.

    Wall Street is showing weakness

    Market volatility
    When the real estate bubble popped, Wall Street finally started seeing subprime loans as a risk rather than an investment. The market has lost at one point over 800 points from our 14,000 point high in the Dow Jones.

    My personal opinion
    There are broad sell offs in Wall Street even though the housing market doesn't even affect it. Health care, industries, and other sectors are not affected by real estate and some have hit their 3 to 5 year lows because of the recent sell offs. This is the time to BUY these good companies and hold for the long term.

    And of course to diversify your portfolio, consider tax liens. Opportunities actually strengthen in a real estate bust because more people are delayed in paying their property taxes, giving you an opportunity to invest and help cities, counties, and their infrastructures.

    Upcoming Tax Auctions - Illinois tax auctions

    CHARLESTON (Illinois) — Eight properties are available in Coles County’s annual delinquent property tax auction, which has a bid deadline of Monday.

    The minimum bid for each property is $644, and sealed bids must be submitted to the county treasurer’s office, 651 Jackson Ave., Charleston, according to information from the county’s tax agent.     Don Sausa consulted for New York Times article


    A week or so ago, I posted some real estate problems in Box Elder County, Utah. Little did I know part of my research would go on national news.

    Dan Barry, a New York Times columnist, travels nationally to look at the sight and sounds of America. On a restaurant stop, he picked up a local newspaper and found an interesting story about illegal subdividing and land sales in Box Elder County, Utah. He finds out the person doing the original subdividing and hunts down the story. He goes on Google, looks for information regarding the land owner and finds my research on my blog.

    He shoots me an email, then we chat on the phone, and I give him some info, and bwam, like a master craftsman, he's got a hot story posted here.

    South Carolina's Supreme Court and Attorney General Scare Off Tax Lien Investors

    We've been following the story of Ned Majors, a fellow tax lien investor from South Carolina. He invests tax liens for other people, by going to the auctions for them and bidding for them (like a proxy bidder). South Carolina's Attorney General Henry McMaster, states this practice is like selling securities. South Carolina's Supreme Court apparently agrees. The court argued that though it isn't exactly like selling securities, it is similar enough that the attorney general has the authority to regulate it.

    Translation: Attorney General McMaster and the Supreme Court needs to buy the book below.



    The attorney general apparently wants Mr. Majors to pay license fees, taxes, and be 'regulated' like other securities company (mutual funds, brokers, etc.). This is astonishing, since the sale of tax liens help local jurisdictions and there are clear state statutes on how they are to be done. The attorney general's 'power grab' from local counties and local cities is remarkably selfish. South Carolina is now officially off limits for major tax lien investors, which removes much needed income to fund roads, schools, and other public services.

    Perhaps, down the road when South Carolina starts having budget woes in their local jurisdictions, the people will remember Attorney General Henry McMaster. The poster child for scaring off investors in his state.

    Warrick County, Indiana tax sale is postponed

    Indiana counties usually have tax sales between July 1st and Nov. 1st...except possibly Warrick County! They are having some new issues with the newly elected auditor and treasurer who can't seem to agree which companies to use for tax lien sales. This little hold up is costing the county over 1 million dollars, money they could have received from tax lien auctions.

    We hope they can resolve the issue soon, it certainly isn't a good reflection of officials being newly elected and then they turn around and stop the funding for basic services like schools and emergency services.

    Warrick tax sale hits snag

    Warrick County will not have a tax sale in 2007 if Treasurer Charlie Christmas and newly elected Auditor Larry Lacer cannot agree on which company to run it.

    In 2006, the financially strapped county brought in about $1,264,500 in back taxes and profit from the sale of properties on which taxes were delinquent. An additional $185,000 was collected before the sale from property owners who paid their back taxes after learning the properties were to go up for sale.

    It's money the county could sorely use again this year, said Carl Conner, a Warrick County commissioner.

    "This county cannot afford all of the services it needs to provide right now," he said.

    Christmas declined to discuss the matter in public when questioned by County Commissioners on Wednesday after Lacer brought it up during a regular public meeting. But he indicated he had objections to SRI Inc., the Indianapolis company that has operated Warrick County's sales since 1998.

    Lacer said employees in his office already are familiar with SRI and its software and are comfortable with the company.

    "It's never been decided not to have a tax sale," Christmas said. "I did not want to air this in public."

    "We are all ultimately responsible to the public," Commissioner Don Williams replied.

    County balances budget with tax lien money

    Erie County is getting some help in balancing its budgets funding schools, roads and other infrastructures through tax lien money.


    Looking ahead, the 2007 budget is balanced, according to county officials, although that will be done without any tax increase and so will likely not have a large surplus. Added tax lien money, collected under a new and better contract, will be used to help restore fund balance.

    Judge reverses La Caribe foreclosures

    Due to the local government's mistake, 11 lots that were not delinquent in taxes were sent to tax foreclosure auctions. According to Gulf Breeze News, a judge reversed the move.


    After only about one hour of presentation and deliberation, property owners in La Caribe subdivision received good news: Judge Michael Allen reversed the foreclosure proceedings on 11 lots accidentally included in a tax lien sale earlier this month. The lots had been erroneously included in the description of the pool deck tax lien auctioned off, and Assistant County Attorney Steven West requested a reversal.
    For the public that do not know -- if you do not pay your property taxes, your property may be auctioned off for a fraction of the market price. On rare occassions like this one, the county makes a mistake. Luckily, it doesn't happen too often.

    We have listed below the most frequently asked questions concerning investing in tax liens.

    1. What are the date, time and location of your tax lien sale? Our tax sale is held the third Thursday of February each year. The tax lien sale starts at 8:30a.m. in the Board of Supervisors meeting room on the first floor, 219 E. Cherry, Flagstaff, AZ 86001

    2. How often do you hold tax lien sales? Once a year, in February.

    3. Does your county hold a deed/land sale in addition to a tax lien sale? If so, when and where does it take place? Yes, you need to contact the COCONINO County Board of Supervisors at (928)779-6693 or write 219 E. Cherry, Flagstaff, AZ 86001

    4. When and where will the tax lien sale be advertised? The Tuesday paper two weeks prior to the week of the sale will have the public notice of the sale. It is advertised in the Arizona Daily Sun. You must contact the Arizona Daily Sun at P.O. Box 1849, Flagstaff, AZ 86002; call (928)774-4545 to get a copy of the notice; or visit their website at www.azdailysun.com. The list is also available on the County Treasurer website.

    5. How and when do I register for the tax sale? Anyone who has a bid number is registered for the tax lien sale. If you are a new investor in our county you should obtain a bid number one week prior to the sale. Complete the Bidder Information Card form and then mail it or bring it to us at 110 E. Cherry Avenue, Flagstaff, Arizona 86001 no later than the Tuesday prior to the sale. The original signed form is required by this office to provide you with the official bidder number.

    6. What type of payment requirements are needed at the sale? Is there a deposit required before the sale? Cash, cashier check, money order, personal checks and credit cards (VISA and MasterCard Only) are accepted. We do not require a deposit. However, payment is due in full in our office by 3:00 p.m. the day of the closing of the tax sale. Money orders, cashier checks, or personal checks need to be for the exact amount of the purchase for the tax lien. If payment is made with cash, payment must be within $5 of purchase. We do not have large amounts of cash on hand for refunds.

    7. What is the bidding process? The bidding process starts with the interest rate at 16% and is bid down in full percent increments if more than one individual is involved. If the parcel is bid down to zero and more than one individual is interested, a drawing will be held to determine which individual will be granted the parcel for the tax lien.

    8. What type of document is issued at the sale? After you have finished bidding, a table will be set up outside the doors where the tax lien sale takes place. You will need to pick up a printout listing all the parcels you bid on and at what % interest rate. It will be your responsibility to verify the lists to ensure its accuracy. Upon receiving payment, you will also be given a receipt reflecting all pertinent information.

    9. Are there any other expenses for the tax lien? There is a $10.00 processing fee. This fee is not included in the advertisement.

    10. What is the foreclosure process and the associated fees? The foreclosure process, which begins three years after the date of the tax lien sale, involves obtaining an insurable deed known as a Judgement Deed. You may choose to hire an attorney or opt for the Judicial Foreclosure-Self Help packet from the Treasurer's website.

    11. What happens to the liens that are not sold at the Tax Lien Sale? Can they be purchased over-the counter? Once the sale has been concluded, you can purchase the liens over the counter. The date the tax liens can be purchased over the counter will be announced at the sale, usually two weeks after the sale.

    12. Is there a list of the delinquent taxes that can be purchased? There is a list in our office for you to view or you may purchase a hard copy or CD for $50.00. (All are updated weekly.) If either the hard copy or CD is to be mailed, please add $10.00 for postage/handling for the hard copy and $3.00 postage/handling for the CD.
    The list must be prepaid prior to mailing it out. You may send in your request by mail with your check made payable to: Coconino County Treasurer; 110 E. Cherry Avenue; Flagstaff, AZ 86001. Visa or MasterCard is also accepted. We do not provide a partial list and because the list is large, we CANNOT FAX the list to you.

    13. Will someone in your office do the research for me? I will be happy to submit the proper fee. All research is to be completed by the investors.

    14. How does the tax sale auction work? Bids will start with the first column listed in the newspaper by item number and continue to the end of the list. Please keep track of any parcels you wish to acquire, along with a notation of the parcels for which you have received the assignment. Once the item number is called, the item will not be called at a later time.

    15. Would you please forward to me a copy of the statutes regarding tax sales in your jurisdiction? To obtain the statutes, you may contact an attorney; inquire at a Law Library that has the Arizona Revised Statutes; or go to the website: www.azleg.state.az.us/ArizonaRevisedStatutes.asp.

    What are tax lien certificates?

    Plenty of people made their millions by investing in real estate; however, not many know that you can invest in this field without much capital. Ever year, properties are taxed for their value and every year, people fail to pay their taxes on time, incurring interest and penalties either due to financial issues or they just misplaced the tax bill.

    If you are late on your property tax bill, the county government seeks investors to balance their budget. Your tax bill will be bought by an investor and when you pay your tax bill with penalties and interest, the net proceeds go to the investor.
    This investment venue is little known because government agencies stink at marketing. But that doesn't mean you can't take advantage of it!

    Remember, without tax lien investors, many counties would have smaller budgets, hurting schools, police, roads, and other public services.
